Ph.Art Gallery Pty Ltd (Ph.Art Gallery) understands that your privacy is important to you.
Ph.Art Gallery is also subject to the requirements of the National Privacy Principles (NPPs) of Australia which are contained in the Privacy Act 1988 (the Privacy Act) and which govern how private sector organisations handle personal information. Personal information is basically information that can identify you.
Privacy policy
Ph.Art Gallery Pty Ltd (Ph.Art) understands that your privacy is important to you.

1 What Personal Information does Ph.Art collect?
- About Ph.Art
Ph.Art Gallery operates an online gallery of digital content contributed by Ph.Art Gallery members, which it commercialises, or makes available for commercialisation under licence by third parties. Ph.Art Gallery collects and uses personal information as part of the operation of the gallery, for the collection and commercialisation of the gallery’s content, to improve users’ experience of the Ph.Art Gallery website, and as part of our day to day business operations.
- Personal information collected
We collect the following types of information:
- personal information collected from members may include name, address, contact details, date of birth, anniversaries, credit card details and bank account details for crediting licence fee payments;
- personal information collected from customers and licensees may include name, address, contact details, credit card details and/or bank account details for deducting licence fee payments;
- personal information collected from business contacts may include name, business position, and business telephone and fax numbers and email addresses;
- personal information collected from our employees and contractors may include all information required for the employment or contractual relationship in question;
- information collected from Ph.Art Gallery website users may include IP addresses and cookies as set out in further detail in Part 6 (Online Privacy) below.
Generally, all personal information is collected directly from you, or with your consent, and our policy is to collect only personal information that we need for a particular purpose. The collection of personal information also enables us to tailor the benefits made available to you and to enhance the experience and value that you acquire as a member. In certain circumstances, we may send and store your information outside of Australia, however we will always maintain the highest standards of security.
- Purpose of collection of personal information
- Ph.Art collects personal information in order to:
- identify members as the authors of digital content to the public on the Ph.Art Gallery website. You may, if you wish, elect not to have your name identified on the Ph.Art Gallery website as the author of content provided by you, but if you do so, you agree that Ph.Art Gallery’s customers and licensees may use that content without identifying you as its author;
- register members of the Ph.Art Gallery;
- the receipt and payment of licence fees to members in respect of the use of licensed content provided or received;
- provide our customers and licensees with our products or services, process transactions with customers and licensees, monitor use of Ph.Art Gallery content under licence, and in order to manage our relationship with our customers, licensees and with the people we do business with;
- manage our relationship with any franchisees;
- operate competitions and award prizes; and
- to improve and personalise users’ experience of the Ph.Art Gallery website.
In relation to our customers and licensees, Ph.Art Gallery may also request information about you in order to help you decide which of our products or services would best suit your requirements.
We will not collect sensitive information about you (such as details of your race, political beliefs, religion or health) at any time without your consent.
2 How is Personal Informationused?
The personal information collected from you by Ph.Art Gallery is used for the purposes set out in 1.3 above, and for other business purposes.
We may from time to time use personal information collected from you to provide you with information about new Ph.Art Gallery products, services, promotions or competitions. If at any time you no longer wish to be notified about new Ph.Art Gallery products, services, promotions or competitions, please let us know by contacting the Privacy Officer (contact details are set out at 7 (Contacting Ph.Art Gallery) below).

3 Will Personal Information be given to anyone else?
In the circumstances described below, personal information may be disclosed outside Ph.Art Gallery.
- Outsourcing
Personal information collected by Ph.Art Gallery may be disclosed to third parties to whom Ph.Art Gallery contracts out specialised functions (including mailing houses and printing companies). If Ph.Art Gallery does disclose personal information to third party contractors under outsourcing or contracting arrangements, Ph.Art Gallery takes steps to ensure that those contractors:
- comply with the NPPs when they handle your personal information; and
- are authorised only to use personal information in order to provide the services or to perform the functions required by Ph.Art Gallery.
In certain circumstances, the personal information may be disclosed to third party contractors located outside of Australia.
- Disclosures required by law
For legal reasons, other disclosures may need to be made to law enforcement agencies, government agencies, courts or external advisors or in accordance with any other laws applying from time to time.
- Other disclosures
Ph.Art may disclose:
- the name of members providing digital content to customers and licensees licensing or acquiring that content, unless the member requests the content to be licensed anonymously, in which case the member agrees that Ph.Art Gallery’s customers and licensees may use that content without identifying the member as its author;
- personal information of members to franchisees of Ph.Art Gallery;
- personal information of competition participants to competition sponsors. Where Ph.Art Gallery intends to do so, this will be clearly indicated in the terms and conditions of the competition; and
- personal information that you place in your biography or other information about you which is otherwise publicly available.
If Ph.Art Gallery does disclose personal information, Ph.Art Gallery takes steps to ensure that recipients:
- comply with the NPPs when they handle your personal information; and
- are authorised only to use personal information for the purposes for which it is disclosed (for example, for the purposes of identifying the author of licensed content or for the purposes of operating franchised gallery services in relation to that content).
Ph.Art Gallery does not sell, rent or trade personal information to or with third parties.
4 Access and correction
Under the Privacy Act, you have a right to seek access to information which Ph.Art Gallery holds about you. You also have the right to ask us to correct information about you which is inaccurate, incomplete or out of date.
If you wish to exercise your right under the Privacy Act to seek access to the personal information that Ph.Art Gallery holds about you, we ask that you contact Ph.Art Gallery’s Privacy Officer (details at point 7 (Contacting Ph.Art Gallery) below), who will explain how Ph.Art Gallery will handle your access request.
To provide you with access to this personal information, Ph.Art Gallery would ordinarily provide you with a print-out of the relevant personal information from our databases, or with photocopies of records which are held only on paper files. If personal information about you (for example, your name and address details) is duplicated across different databases, we will generally provide you with one printout of this information only. Ordinarily, Ph.Art Gallery will not charge you for the cost of providing this type of access to these records however we reserve the right to do so at our discretion.
For legal and administrative reasons, Ph.Art Gallery may also store records containing personal information in its archives. You may seek access to the records held by Ph.Art Gallery which are not current records, but if you do so, we may charge you a reasonable amount for the cost of providing access. If you are of the view that personal information about you is not accurate, complete or up to date, please click on EDIT MY PROFILE or contact us in accordance with clause 7 below.
5 Is Personal Information stored safely?
Ph.Art Gallery takes reasonable steps to ensure the security of personal information held by it from such risks as loss or unauthorised access, destruction, use, modification or disclosure. Our IT systems are password protected and comply with our security standards [insert security standard applicable – Fabric to write]. Ph.Art Gallery only permits your details to be accessed by authorised personnel.
6 Online privacy
This privacy statement outlines Ph.Art Gallery’s approach to all personal information we handle, whether collected online or offline. However, particular issues that arise in the online environment are noted below.
Sometimes we may generate statistics about how many people visit our website and what they look at. We use IP addresses and cookies to do this. This enables us to keep our website relevant and useful and to personalise your experience of the website. Generally the information we collect and use about website usage will not identify you, only the computer you are using. Most web browsers are set by default to accept cookies. However, if you do not wish to receive cookies you may set your browser to either refuse cookies or prompt you before accepting them although this may prevent some functions of the Ph.Art Gallery website from working correctly.
Sometimes our website contains links to other websites, for your convenience and information. When you access a website other than www.phartgallery.com please understand that we are not responsible for the privacy practices of that site.
