Copyright and IP policy

Pursuant to the General Membership Policy, the Public Gallery Licensing Agreement and the Collector's Gallery Licensing Agreement agreed to by all members joining and participating in the activities and the promotions of Ph.Art Gallery Pty Ltd (Photo Art Gallery) the Copyright policy of the firm stipulates, for all intents and purpose, that the Copyright of all images shall remain with the Photographer.
Members of the Gallery agree to the terms and conditions of each Gallery, Competitions and other events when submitting Photos to those areas or events and should be mindful of the terms and conditions pertaining to each Gallery or Event.
Whilst the Copyright of images remains with the Photographer, Licensing Agreements that form part of the participation in these Galleries do license use of and promotion of the images, for the purposes of generating sales revenue and opportunities for members to the Gallery.
In some instances this is a Non-Exclusive License and in others (such as the Collector's Gallery) the license is exclusive to Photo Art Gallery for the purposes of protecting the collectible nature of the Artwork for purchasers. Such licenses do not exclude the photographers use of the images for Personal or Commercial uses in most instances as Photo Art Gallery’s intent is only to protect the value of the Artists work and the value which is afforded to it by purchasers and collectors.
Members and participants should always read and understand the agreements they enter into as participants in this Gallery. If users have any concerns or queries in relation to the Copyright policies of Photo Art Gallery please contact us as we would be pleased to answer them and assist in any way.
The IP of this website and other discussed or developed by Ph.Art Gallery Pty Ltd remains the exclusive property of the firm at all times and cannot be used or reproduced in whole or in part without express consent of the company.
